WorkCover is the state government agency that administers work health and safety and workers compensation laws.  Workcover gives advice and other information on work health and safety and workers compensation issues to businesses, workers and others in the community. It also conducts initiatives on specific work related issues, such as programs to encourage youth employment.

At certain times, Workcover is involved in investigating ‘workplace incidents’ and this involves sending inspectors to investigate work health and safety complaints, incidents and high risk situations and, where necessary, to prosecute breaches of work health and safety laws.

The process involves an incident or high risk situation occurring, which is an alleged breach of work health and safety laws, and in serious cases this could involve serious injury or death. The person in control of the workplace notifying WorkCover and an investigation that is conducted by Workcover.  Investigations are complex and their length can be affected by, among other things, the cooperation of the people involved and the evidence gathering process. The inspector will marshal evidence and often require statements to be taken by the affected person, alleged accused person, witnesses and other interested parties.  Evidence collected can include taking photos, information, samples and other materials. A qualified Employment Lawyer may be able to assist you throughout any Workcover Investigation that you may be involved in.

WorkCover will then complete its investigation and decide whether a breach of work health and safety laws has occurred.  It will then determine an appropriate response which can range from no further action, to warnings, notices and, in serious cases, prosecutions. Inspector prepares report, which discusses the causes or background of the matter under investigation, and the inspector’s recommended response. In serious incidents, the persons involved will be notified of the investigation’s outcomes.
