Traffic disputes commonly include a dispute about a motor vehicle accident ("MVA") and resulting property damage or injury. There are often disagreements about:
- Liability - whose conduct contributed to the MVA?
- Damage/ Injury- was the damage or injury caused by the MVA?
- Quantum- how much will it cost to repair the damage or treat the resulting injuries?
- Insurance- are the parties insured? Have the insurance details been disclosed? Will the insurance cover the damage/ injury sustained or does an exclusion apply?
Traffic disputes may also refer to disputes about criminal offences resulting in:
- A penalty notice issued following a traffic infringement;
- A notice of suspension of licence issued by the RMS;
- Damage to a motor vehicle owned by another;
- Road rage resulting in the use of abusive language/ assault/ property damage.
In some instances there may be an opportunity to engage in alternative dispute resolution such as conciliation, mediation and negotiation. These are especially common where the dispute involves an MVA but may also be available in criminal matters where the laying of charges will be affected by the wishes of the offender.
