Tax disputes can often arise due to a delay in the lodgment of documents with the Australian Taxation Office ("ATO"), the lodgment of inaccurate documentation or the quantum of taxation charged. Disputes usually pertain to the ATO issuing a demand for payment of taxation, and, where overdue, interest on the unpaid amount.
As such demands are often unexpected by the taxation payer, many find themselves in a situation where they do not have the immediate funds available to satisfy their debt to the ATO. In an effort to recover the amount owed, the ATO can bring legal action against the indebted individual/ company.
In our experience, the most appropriate means of alternative dispute resolution in such circumstances is negotiating with the ATO as to the date and quantum of payment, and where necessary, proposed instalment plans.
