Disputes between family members can include disputes about:

- Joint investments and businesses;
- Distribution of deceased estates;
Alternative dispute resolution mechanisms such as conciliation and mediation may assist family members reach a resolution without the need for legal proceedings. Both conciliation and mediation involves a third person assisting the parties in identifying the points of contention and assist in the discussion process. The main difference between conciliation and mediation being that mediators are always independent persons and it is typically conducted on a more formal basis. Negotiation is also commonly utilised during the course of a dispute between family members.
We recommend that, even between family members, should an agreement be reached during an informal resolution process, that the terms of this agreement be incorporated into a legal contract which can be enforced.
