In some instances parties to a dispute must engage in mediation either prior to commencing legal proceedings or at some stage during the course of proceedings. This may include some employment disputes and disputes arising from contracts which have a dispute resolution clause which prescribes for mediation to occur.
Mediation involves an independent third party meeting with the parties to discuss the dispute and assist the parties in trying to reach a settlement.
Compulsory mediation provides the parties with an opportunity to attempt to resolve the dispute before it escalates or otherwise continues through the judicial system.
