An offence of embezzlement involves the misappropriation of funds that do not belong to you but are under your care. It is a type of deception offence and commonly takes place in the context of an employer-employee relationship. An example of this offence would be a clerk or assistant receiving money on behalf of his or her employer and then using those proceeds for his or her benefit. The offence of embezzlement is considered to be a serious crime and involves a maximum penalty of ten (10) years.   1. The defendant was a clerk or servant at the time of the offence;

  3. The defendant used the money and/or assets for his or her own benefit.
