Development Conditions:

Overview FAQs Articles Locations

In NSW there are a number of different levels of approval which may be required depending on the level of development which is being proposed. The salient considerations to your development may be:

  • The size and cost of your development;
  • The zoning, location and restrictions placed on your land (usually identifiable from the s149 certificate issued by the Local Council);
  • The heritage status of your land, buildings and surrounding land;

These matters may determine if development is allowed, if consent is required for the development, and if so, any conditions or restrictions that may apply.

At Navado we may be able to assist by advising as to the type of development that may be undertaken on your land, the conditions or restrictions by which you must comply and in compiling the application for development approval. In some instances, the Local Council may request further information prior to determining your application, or objections may be lodged to which  you may wish to respond. Navado will be able to assist with each step of this process.

Navado also has experience in advising clients who have had their development application rejected or approved subject to specific conditions being met. We have acted for many clients who have successfully challenge the decision of the Council at the Land and Environment Court.

If you require assistance with your development application matter, we recommend that you contact our firm on (02) 9233 4048 or send an email to info@navado.com.au and arrange an appointment to see one of our Compliance & Regulatory Law Solicitors.
