The NSW Department of Education & Training (“DET”) is regulated by various codes and policies which specifies the standards of behaviour expected of teachers in the course of their duties. Independent and private schools commonly have their own Codes of Conduct to which their staff are to adhere.

The Codes of Conduct generally provide:

  • Prohibitions on discrimination;
  • Guidelines for the discipline of students;
  • Obligations to comply with workplace, health and safety guidelines;
  • Complaint handling procedures;
  • Sanctions available if there is a non-compliance with the Codes of Conduct.

If there is an alleged breach of the Code of Conduct it may be investigated and sanctions imposed if the breach is substantiated. Sanctions may include counselling, warnings, suspension or termination depending on the nature of the contravention, the history of the teacher and the circumstances of the breach.
