Expatriates Law:

Overview FAQs Articles Locations

Expatriates looking for legal advice may want to retain a civil and commercial litigation lawyer. For those who have spent a great deal of time away from Australian shores, there may have been significant changes to the legal system that can affect the way that business is conducted, the terms and conditions of employment, tax liabilities and other areas of day to day legal conduct. A commercial and civil lawyer will most likely be able to provide general advice on these changes and advise the expatriate on his or her duties, rights and responsibilities.

Solicitors who advise expatriates will consider legal issues form a broad cross-section of practice areas so that the “expat legal advice” is as comprehensive and useful as possible. For this reason, the advice should optimally be sought from a civil litigation solicitor who has had experience with commercial litigation and legal advice as well. Likewise, a commercial litigation solicitor who has dealt with and had carriage of civil litigation matters will also be able to assess the wide range of commercial legal issues that could be relevant to the expatriate.

The cross-disciplinary experience of a solicitor or lawyer will constitute the greatest asset for an expatriate who wishes to resettle in Australia efficiently and economically while ensuring that his or her legal obligations have been met and his or her legal rights have been reserved. A legal practitioner who is able to draw from the extensive library of skills and knowledge, spanning both civil and commercial legal advice, will be able to guide the expat in relation to the complexities of the legal system. This is particularly the case where the expatriate has a business or she or he wishes to relocate to Australian shores.

Some of the general areas that the expatriate team at Navado will be in a position to consider and advise our clients on include tax liabilities and obligations of expatriates, effect of family law statutory provisions, the effect of holding title to property overseas and acquisition of property here in Australia, issues relating to employment (taking into consideration both statutory and common law principles), tenancy issues, driving, as well as general advice on migration, citizenship and/or permanent residency matters.

Expats who return to Australia may be taken advantage of due to their being unaware of changes to the legal system and certain bureaucratic procedures. It is important that the expat knows his or her rights before embarking on any major transaction, as there may be serious consequences arising from rash decisions.
