Credit Defaults and Credit Repair Disputes:

Credit default disputes can arise in many situations, and these naturally have a strong commercial flavour. The credit default dispute may arise in the context of a dispute concerning the interpretation of a loan agreement of a contract for the performance of a service or the provision of certain goods. There may be a question as to whether the duty for immediate payment has in fact been triggered. There may be an issue relating to certain conditions that must first be satisfied. Either way, a credit default solicitor will need to consider all relevant documents, as well as documents used in the preparation of any contract, before credit default legal advice can be provided. Each situation is unique, and no formulaic answer can be given to a client or potential litigant (whether the litigant is the alleged creditor or the alleged debtor) by the credit default lawyer.

Credit repair disputes can of course also arise from credit default disputes. These may be contingent on the resolution of the credit default dispute, and therefore there may be a great deal of investigative and legal research that will first need to be undertaken before any formal action can be pursued in the credit repair issue. But this does not always have to be the case. Some credit repair disputes may arise from errors such as mistaken identity. Where an individual’s name has been wrongly put on a database, severe damage can be done to his reputation. Likewise, his business may suffer and he may not be able to obtain a loan at market rates (or at all). These issues are very serious and need to be attended to at the aggrieved party’s earliest possible convenience.

A credit repair solicitor will be able to liaise with a credit reporting agency and seek the correction of their register. Certain procedures will need to be followed and the credit repair lawyer will need to obtain a detailed statement from his client so that the agency has all the facts before it to give effect to the correction. Disputes with credit repair agencies can also arise, and credit repair litigation may be the only alternative available if all other processes have been exhausted.
