The Children's Court can make an assessment order which is an order that a child be medically examined and/or assessed. For the purposes of completing an assessment, the child's primary carer can also be assessed to determine whether they are capable of caring for the child.   

An application for an assessment order can be made to the Children’s Court by the Secretary of the Department of Communities & Justice or a party to any pre-existing care application filed with the Children's Court. 

 When considering whether to make an assessment order, the Children's Court will consider matters such as:  

  • The value in the proposed assessment and if the information could be obtained through an alternative avenue; 
  • Any distress the proposed assessment will cause and whether this is outweighed by the importance of an assessment; 
  • Any previous distress to the child from a previous assessment; 
  • Other matters the Court may consider relevant on a case by case basis.
