An Apprehended Violence Order (“AVO”) is a Court Order made to protect a person (“the Protected Person”) from being stalked, intimidated, harassed, molested or assaulted by another person (“the Defendant”).

An AVO is made upon an application to the Local Court. This application may be brought by the Police or by the Protected Person privately. Once an application is made, the Defendant will receive notice of the application and will be ordered to attend Court to respond to the application.

During the Court proceedings, an AVO application may be withdrawn. AVO applications are most commonly withdrawn where the Protected Person lodged the application personally with the Court. Where the police have filed the application they will not withdraw the application unless they are satisfied there is no ongoing risk to the safety of the Protected Person or their children. The Police may seek to withdraw the application if they consider it appropriate in the circumstances, for example, if one of the parties has relocated and the Protected Person does not believe it to be necessary for an AVO. Generally, the fact that a protected person does not want an AVO application to be pursued, is not a sufficient ground for the police to seek a withdrawal.
