An Apprehended Violence Order (“AVO”) is a Court Order that is made for the protection and safety of a person (known as the “Protected Person”). An AVO imposes prohibitions and restrictions on the contact that another person, called the “Defendant” can have with the Protected Person.

Some common conditions include restrictions on:

  • The Defendant approaching the Protected Person;
  • The Defendant attending the Protected Person’s residence, workplace or another commonly frequented premises;
  • Contact the Defendant can have with the Protected Person after consuming alcohol or illicit drugs;
  • The Defendant’s access to firearms or weapons;
  • Any conduct by the Defendant that may have an effect on the Protected Person.

A Defendant must comply with any prohibitions and restrictions set out in the AVO. A contravention of an AVO is a criminal offence which can lead to a fine and/or imprisonment being handed down by the Court.

Any contravention of an AVO should be immediately reported to police by the Protected Person.
