Where a person (“the Protected Person”) is in fear of being assaulted, intimidated or stalked by another person, they are able to make an application to the Local Court for an Apprehended Violence Order (“AVO). A private application can be made by an individual where:

  • The Protected Person has not informed the police of their fear and elect to bring the application personally; or
  • The Police have refused to lodge an application for an AVO on behalf of the Protected Person.

An applicant may seek one of two types of AVO:

  1. Apprehended Domestic Violence Order (“ADVO”) – Where the protected person is, or has previously been in a domestic relationship with the other person;
  2. Apprehended Personal Violence Order (“APVO”)- Where a non-domestic relationship exists between the parties.

If an AVO is granted it will impose restrictions and/or prohibitions on the conduct and movement of the other party, designed to protect the safety of the Protected Person/s.
