The Royal Society for the Prevention of Cruelty to Animals (RSPCA) aims to educate the public on the prevention of animal cruelty, and provides care for animals who have been subjected to cruelty or neglect or who are otherwise injured and in need of treatment.

The RSPCA provides shelters for injured animals and is also involved in the investigation of animal cruelty allegations. The RSPCA has the power to investigate:

  • Abandoned animals;
  • Cruelty to animals;
  • Livestock affected by drought;
  • Owners with an excessive number of animals;
  • Pet shops and their keeping of animals.

The RSPCA’s investigation process involves an inspector attending the premises where the animals are held to examine the animal and question the owner, or otherwise the person in control of the animal, about the animal’s condition.

If the RSPCA inspector has concerns about the care being provided to the animal, they can:

  • Provide the owner with advice as to how the animal can be better cared for;
  • Issue an official warning to the owner;
  • Seize and/or dispose of the animal;
  • Issue a penalty notice if a reasonable explanation is not provided as to why an official warning has not been complied with.
