The Prevention of Cruelty to Animals Act (“the Act”) aims to promote the welfare of animals and prohibit acts of cruelty against animals.

The RSPCA has been delegated power under the Act to investigate complaints of cruelty to animals and, if they are of the opinion that an offence has occurred, can issue a penalty notice (ie a fine). Some offences under the Act include:

  • Cruelty and aggravated cruelty to animals;
  • Failure to provide adequate food, drink or shelter;
  • Abandonment of animals;
  • Failure to report the injuries of an animal hit by a driver of a motor vehicle;
  • Animal fighting.

If the person served with the penalty notice does not want to have the matter determined by the Local Court, they can pay the fine by the due date. The maximum penalty notice available to be issued by the RSPCA is prescribed by the Act.
