Destruction Orders:

A destruction order is an order of the Local Court that a dog be destroyed by a certain date. Such an order can be made if the Court is satisfied that a control order or an order for a removal of the dog from its owner, would not sufficiently protect the public.

The Court will have the option of making the order if:

  • The owner is convicted of an offence following injury or death being occasioned by their dog; or
  • The owner is convicted of certain offences under the Companion Animals Act or Crimes Act (eg encouraging the dog to attack);
  • The dog is declared a dangerous dog and the Local Council refuses to revoke this declaration.

Other orders may accompany a destruction order, such as an order that the owner pay any costs associated with the destruction of the dog.

If the owner does not comply with a destruction order, it is an offence and a penalty notice may be issued to the owner.
