Breeders Obligations:

Under the Animal and Pet Laws within NSW, there are limited obligations specifically directed at breeders. However, there are some general requirements that apply to those breeders selling companion animals such as dogs and cats. Such requirements include:

  • Prohibition on the sale of a dangerous, menacing or restricted dog or a dog that is being considered being declared dangerous, menacing or restricted;
  • Prohibition on the breeding of a restricted dog or one that is being considered to be declared a restricted dog;
  • Notification of change of ownership if the animal is unregistered;
  • Microchipping the dog or cat prior to its sale.

A failure to comply with these obligations is an offence and a penalty notice may be issued by the Local Council.

In addition, a breeder can contract with the person purchasing the animal. This contract often sets out warranties and representations as to the health or ability of the animal being sold. For example, if a breeder is selling a cat or dog, the following provisions may appear in the contract:

  • That the breeder has wormed the cat / dog;
  • The breeder has had the cat/dog assessed by a qualified veterinarian;
  • That the cat/ dog is of a healthy genetic background.

Civil remedies may be available if there has been a breach of contract by the breeder.
