Estate Planning involves a consideration of how you want your assets to be distributed upon your death and making arrangements necessary to assist in the realization of your testamentary intentions. This planning phase may include:

 Providing instructions for a new will to be prepared or for an existing will to be updated (if necessary);

  • Ensuring that a superannuation fund has a record of the nominated a beneficiary. This is the person/s who will receive your superannuation entitlements upon death;
  • If you own property as a joint tenant, considering whether to sever the joint tenancy to allow your share of this property to be distributed under your will or otherwise to retain the joint tenancy so it will automatically revert to the other co-owner;
  • Deciding whether trusts should be set up for your beneficiaries. This will depend on several factors but most commonly the size of the estate, the age of the beneficiaries and where there are concerns about the use of the inheritance if it was not overseen by a trustee.

 The simplicity or complexity of estate planning are primarily influenced by the value of the estate, the type of assets and family circumstances.
