Applications in this Division are made under the National Disability Insurance Scheme Act 2013 (Cth) (NDIS Act). The NDIS Act, governs the National Disability Insurance Scheme (NDIS), which supports people with a permanent or significant disability which can affect their ability to participate in everyday activities.

Under the scheme the Federal Government assists applicants in putting into place supports they need to assist in the day to day running of their lives. These supports usually include attaining the goals of independence, involvement in the community, further education possibilities, greater employment opportunities and better health and well-being. Funding can be obtained from the Government to fund reasonable supports to help a participant obtain their goals which can include, therapies, equipment, home modifications and mobility equipment.

To access the NDIS a participant will need to meet the following requirements:

  •  Have a permanent and significant disability that affects their ability to take part in day to day activities.
  • Be aged less than 65 when they first access the scheme
  • Be an Australian citizen, permanent resident or a New Zealand citizen who holds a Protected Category Visa.
  • Live in a trial site location during the trial.

The AAT has the power to review NDIS decisions and provide support services for applicants.

The decisions that the AAT can review include:

  • Decisions on eligibility to access the Scheme.
  • Decisions on eligibility to supports offered under the Scheme.
  • Decisions in relation to the eligibility of and registration of providers of supports under the Scheme.
  • Decisions that the NDIS Act allows to be reviewed.

However, prior to any AAT review, an internal review of the agency who rejected the claim must be undertaken.
