In general terms, plant and equipment are the common and specialised equipment used in a business. Stock on the other hand refers to the consumable items that are usually sold or disposed of in the course of operating a business. Examples of plant and equipment include photocopiers, heavy and light machinery and office equipment. Examples of stock include food, drinks and paper. A Sydney Conveyancing Lawyer or Conveyancer can usually tell you what enquiries and inspections should be considered or made in relation to plant, equipment and stock.
There are a number of different factors that need to be considered when purchasing a business or commercial property with plant, equipment and stock. These may include that the:-
- plant and equipment are in good condition and in working order
- vendor has title to the plant, equipment and stock, and it is not subject to a charge by any third party
- purchaser conduct a thorough inspection of the plant and equipment
- purchaser arrange a valuation of the plant, equipment and stock
A purchaser must always remember that the contract will have been put together by the vendor for the vendor’s benefit and the purchaser must make their own enquiries and satisfy themselves as to the nature, condition and value of plant, equipment and stock.
