We have no doubt that choosing the right Commercial Conveyancing Lawyer is a very important step for you. So, we have set out some key points that you should consider, when deciding.

1. Look for an established Conveyancing Law firm.

Commercial Conveyancing, when done properly, requires attention to detail and experience. There are also so many different types of issues and matters that can arise within a Commercial conveyance. An established law firm will usually have dealt with a wide range of matters and have been exposed to different issues that arise on a day to day basis, in Commercial Conveyancing matters. It is also very likely that an established firm would have developed systems and procedures to ensure fast, efficient, yet quality reliable Commercial Conveyancing services.

2. Competitive pricing is important, but not everything

Whilst it is always preferable to save money where possible, it is important to ask the Conveyancing team precisely what is being provided for the money that you are agreeing to pay.

3. Look for a ‘can-do’ attitude in the Conveyancing team

The Conveyancing team should be excited about the prospect of taking on your Commercial Conveyaning matter. It is soothing to experience a warm, welcoming attitude, with a team that is willing to work on a positive note, with a view to getting things done, as quickly as possible.

4. Quick response time to phone calls and emails

Make a phone call or send an email – and wait to see how long it takes to get a response, before you engage the team

Conveyancing services are all that more pleasant when the Conveyancing team understands the importance of returning phone calls and replying to emails promptly and as soon as possible. This becomes especially important when you are buying or selling and you need to act quickly.

5. Ask if they have regular repeat business

Firms that receive regular repeat Conveyancing business are usually well respected and deliver a good service, to the satisfaction of their clients.  Ask the Conveyancing team, before you engage them, whether they enjoy regular repeat business.

6. Ask if they outsource settlements or send their own staff

Many Conveyancing Lawyers and Conveyancers do not attend settlements themselves, but rather outsource this work to settlement agents, who attend on their behalf. Settlement agents have usually had not carriage of the entire file, are not familiar with the entire matter and take instructions from the Conveyancing team. In our view, it is preferred that the Commercial Conveyancing team, who should ideally be based in Sydney CBD, will send its own staff, with your file, to the Settlement, which will usually be in Sydney CBD, minutes away. That way, if there are any questions or anything goes wrong, the Conveyancing team can respond instantaneously, with reference to your file, if necessary.

7. Choose staff that are humble and hard working

Whilst Conveyancing matters can raise interesting and complicated legal questions and issues from time to time, much of the Conveyancing process, after Contracts have been exchanged, is procedural routine work. It therefore becomes important to ensure that the Commercial Conveyancing team is humble and hard-working, because a humble and hard working team will always be glad to be your Conveyancing team and will remain motivated at all times, in your matter.

8. Look for Senior Staff with strong formal qualifications

Lawyers who are experienced in Conveyancing and Litigation will be able to value-add to your matter, because they will be familiar with not only the Conveyancing transactional process, but more importantly, with what happens when things go wrong and you end up in a Court room. Ask the Conveyancing team if their senior staff are university or formally qualified, if lawyers oversee the work and if they have handled litigated and disputed Conveyancing matters. Strong university or formal qualifications, such as an Honours Degree in Law, will usually be telling of a lawyer who worked very hard during his or her study or university days, to obtain distinguished and outstanding results – it usually goes without saying that their technical competence will be strong.

9. Make sure the Senior Staff oversee the process

Many law firms employ Lawyers with strong and distinguished University results. What you need to find out, when appointing a Conveyaning team, is whether the lawyers that have strong University results and strong technical competence, are responsible for and are personally overseeing the work being performed by the Commercial Conveyancing team.

10. Ask about their technology platforms

In this modern day and age, it is important that the Conveyancing team operates with state of the art technology, when it comes to software, printing, scanning, emailing and faxing. This is especially important in Conveyancing matters, when electronic records need to be stored and fast response times are required and whole documents need to be scanned and emailed and faxed at high speeds and stored in electronic mediums. Back-up of electronic data is also very crucial, especially when things go wrong.
