Who administers my Will after my passing?

An Estate Lawyer can assist you prepare a will that adequately reflects your testamentary wishes and addresses the administration of your will. Your will should appoint an executor who is responsible for the administration of your will and the general adherence to your wishes. Your Estate Lawyer may also suggest that your will should also appoint a trustee who will hold your estate assets in trust, pending their disbursement amongst the beneficiaries or until the terms of any testamentary trust have been met. Often, for convenience, the executor acts as the trustee as well.

There are many things to consider when drafting a Will.  For example, have you considered whether the nominated executor or trustee is too old to be burdened with such a task? Is there a more responsible or well organised person you have in mind to take on the role? If you have nominated your spouse or parent, is this really the right choice (keeping in mind that they will be deeply affected by your death)?
