Equity Law

Equity Law is, primarily, about fairness.

In New South Wales, The Supreme Court of New South Wales deals with the majority of claims involving principles of Equity.

We are experienced with the basic concepts of Equity, which include Equitable Estates and Interests, as well as Equitable Priorities (as they may affect property interests, for example).

We are also experienced with advising in relation to the various basic grounds for relief in Equity, which include but are not limited to the Fiduciary Relationship, as well as the principles of Mistake, Misrepresentation and Undue Influence.

We can also advise on matters relating to Estoppel in Equity, Donationes Mortis Causa, Contribution and Subrogation.

Some of these matters touch and concern individuals, small companies and businesses and also affect the largest of Corporations, every day.

These are matters which are often considered as part and parcel of a Litigation claim, but which may be considered in their own merit.

Two of the most common Equitable remedies are Injunctions, as well as Specific Performance. These considerations arise on a daily basis, in many commerical and every day dealings that we advise on.

Trusts Law

We are very experienced in advising in relation to transcations involving Trust Law.

There is, of course, a distinction between what amounts to a Trust and what does not.

We have advised on the requirements for express trusts.

We have also advised on trust for Charitable purposes.

Many cases we have handled, or matters that we have advised on, have included and called for advice regarding Resulting Trusts or Constructive Trusts, or both.

In the past, we have advised on the duties and entitlements of the Trustee, as well as the beneficiary, in various forms of Trusts.
