Contract Law / Negligence Law

Perhaps the most two (2) fundamental areas of Civil Law are Contract Law and Negligence Law.  Contracts (or agreements) are a common occurrence in everyday life and on a daily basis, many persons breach Contracts or agreements.  In addition, on a daily basis, many persons or companies encounter situations where they either owe a Duty of Care, or a Duty of care is owed to them.  In general terms, a breach of duty of care is an element of Negligence.

Contract Law

We are experienced in Contract Law and we have assisted many individuals in drafting Contracts or agreements to reflect the intention of two or more persons that are entering into a Contract or an agreement.

We have sound experience in drafting Contracts, including (but not limited to) Shareholder Agreements, Confidentiality Agreements, Employment Agreements, Sale of Business Agreements, Partnership Agreements, Joint Venture Agreements, Deeds of Assignment, Commercial Leases, Licences to Occupy, Licences of Copyright, Trademarks and Intellectual Property generally, as well as Contracts required in the Information Technology Sector. We can also assist in the drafting of Distribution Agreements, Supply Agreements, Terms of Trade or help you to document any other specific agreements that are tailor-made to suit a business or commercial arrangement or agreement that you have arrived at or may be negotiatiing.

We assist clients to interpret and understand Contracts and agreements, as well as understand their rights and obligations under any Contract or agreement.  Where there is a breach of any Contract or agreement, we can assist in enforcing such a breach of the Contract or agreement, where possible.

Negligence Law

In every day life, many persons, businesses or legal entities owe a Duty of care to others.

We can assist you to understand what (if any) Duty of Care is owed to you by a person or by persons, or what Duty of Care (if any) you might owe to a person or to persons.

We can also assist you to ascertain whether there has been a breach of such Duty of Care (if any) and whether, as a result of such a breach of the Duty of Care, any person has suffered damages.

The study and analysis of such concepts falls within the realm of Negligence Law.
