Bankruptcy & Insolvency Litigation
We have handled various Bankruptcy & Insolvency Litigation matters. We have defended Australian Companies on the receiving end of a Statutory Demand. We have assisted Companies in preventing an Order for Winding up of the Company being made and we have also assisted Companies in bringing various Applications to the Supreme Court of New South Wales, including Applications to terminate the winding up of a Company. We have also acted for Liquidators in obtaining Court Judgments and recovering debts.
Building & Construction Litigation
We have extensive knowledge in Building & Construction Litigation. We are very familiar with Litigation (Court Work) as it relates to Construction Contracts, the Building and Construction Industry Security of Payment Act, Extensions of Time, Variations to Scope of Works, Liquidated Damages, as well as the principles of Quantum Meruit and other principles of Equity that might be relevant to Construction Law. We have acted in the Local Court, District Court and Supreme Court of New South Wales, in relation to Building & Construction Law matters. We have access to Sydney's leading Construction & Litigation Barristers.
Commercial Litigation
We are experienced in Litigating disputes generally revolving around Commercial Transactions. In particular, we have good knowledge of Sale of Goods Legislation, the Trade Practices Act and the Fair Trading Act (in particular, misuse of market power, anti-competitive agreements, price discrimination, misleading & deceptive conduct, and unconscionable conduct claims), Personal Property issues and Bailment. We have acted for many Commercial clients and represented many Commercial clients in Court matters involving Contractual Disputes. We are very familiar with the principles of Equity that might relate to such Transactions.
