Many individuals face financial difficulties and are often subject to Bankruptcy Proceedings or Court action in the Federal Court of Australia or the Federal Magistrates Court. We represent persons being sued or subjected to Bankruptcy proceedings.
Many Bankruptcy Applications follow from circumstances where Judgment has been obtained against a debtor and the debtor has refused to pay the judgment debt. In such circumstances, Bankruptcy Proceedings may be initiated, with a view to Bankrupting the individual in question.
We can also assist you to Bankrupt a person who is indebted to you, where they refuse to pay outstanding monies. We are familiar with commencing applications filed in the Insolvency Trustee Service of Australia (ITSA) and following through with Bankruptcy proceedings in the Federal Court of Australia.
Insolvency Law
We are familiar with the general provisions of the Corporations Legislation, including the provisions that relate to administration, receivership and liquidation of companies. We understand that companies may experience financial trouble; and we are able to assist Australian companies in their attempt to resolve their financial difficulties.
We have acted for, and against, liquidators. We have acted for liquidators in obtaining judgment against individuals indebted to companies in liquidation. We have defended Australian companies who have been served with a Statutory Demand. We have assisted companies in preventing an Order for winding up of the company being made; and we have also assisted companies in bringing various Applications to the Supreme Court of New South Wales, including Applications to terminate the winding up of a Company.
